SYDNEY, N.S. -- A Cape Breton man has been charged after a close call with a train earlier this week.

Police were called to the Sydney Coal Railway property Monday afternoon after a train collided with an unoccupied dirt bike.

It's alleged the driver of the dirt bike was travelling along the railway tracks near May Street and Daley Road when the train approached.

Police say the driver managed to jump off the bike and out of harm's way before the train hit.

No one was hurt and the train was not damaged.

Police say a 28-year-old Dominion man is charged with operating an off-highway vehicle on property without written permission under the Off-Highway Vehicles Act.

The charge carries a fine of just over $406.

The man has also been prohibited from entering the railway property for one year.
