MONCTON, N.B. -- An RCMP investigation into allegations that a labour-inducing drug had been inappropriately administered to pregnant women at the Moncton Hospital last year is now closed.

The RCMP said Tuesday there will be no criminal charges and the decision has upset some of the women involved in a proposed class-action lawsuit.

Beverly Cuppens-Buckle is speaking out on behalf of her daughter Jayde Scott.

Jayde is the representative plaintiff in a proposed class-action lawsuit against the Moncton Hospital and a former nurse. She alleges her emergency C-section while delivering twins last year was the result of a labour-inducing drug administered without her consent.

"Jayde has post-traumatic stress disorder," says Cuppens-Buckle. "She's throwing up all day, all night. She is hyper, hyper-vigilant where her children are concerned."

The lawsuit launched against Horizon Health and former nurse Nicole Ruest is on behalf of several women who claim they were inappropriately given oxytocin.

"I think that's absolutely egregious," said Cuppens-Buckle. "I think it's absolutely disgusting."

In a statement, the Crown says prosecutors reviewed the file and determined there was insufficient evidence to proceed with charges.

"Nobody's interviewed me from the RCMP or the Crown prosecutor's office to see what I saw, what I know," said Cuppens-Buckle. "Actually, the father of the babies who was in there the whole time with them was never interviewed for this criminal investigation."

Ruest's lawyer, Andrew Faith, called the claims unfounded and said in a statement:

"Nicole has always maintained her innocence and intends to vigorously reclaim her dignity and reputation — and most importantly, her role as a care provider — in the months and years ahead."

Said Cuppens-Buckle: "My daughter and many moms went to that hospital for proper care, to deliver a baby, and instead were traumatized."

Horizon Health said in a statement: "We have recently learned there will be no criminal charges laid involving a nurse who worked in the labour and delivery unit at Horizon’s The Moncton Hospital in March 2019. As there are still matters related to this incident before the courts, we will not provide any further comment."

Jayde Scott's mother says news of the closed investigation is infuriating.

"It breaks my heart to see a mother clinging to her child because she's afraid," Cuppens-Buckle said.

None of the claims in the lawsuit, which has yet to be certified, have been tested in court.
